PRIVACY POLICY

Introduction

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from  (the “Site”). Please also read our “Terms of Use Agreement” which help governs your use of the PXSH “Sites”. 

This Privacy Policy only applies to the information collected by PXSH Media LLC, any authorized affiliate by contractual agreement (collectively, “PXSH”, “we”, “our”, or “us”), third parties acting with our written authorization,  information given to us from third parties about you in connection to your use of any PXSH Site. This Privacy Policy applies to any user regardless of whether you are accessing the PXSH Sites or application. 

Personal Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, geolocation information, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

 “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

 “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

 “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

 “Geolocation information” is collected through your IP address for us to determine your general geolocation or region, which we use to enhance the delivery of content in your language and provide localized advertising. 

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit and debit card numbers), email address, and phone number.  We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

How Do We Use Your Personal Information? 

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

Communicate with you;

Fulfill our contractual obligations under an existing agreement with you including delivery of content;

Screen our orders for potential risk or fraud; and

When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Sharing Your Personal Information

We share your Personal Information with third parties to help us use your Personal Information, as described above.  For example, we use Shopify to power our online store–you can read more about how Shopify uses your Personal Information here:  https://www.shopify.com/legal/privacy.  

We also use Google Analytics to help us understand how our customers use the Site–you can read more about how Google uses your Personal Information here:  https://www.google.com/intl/en/policies/privacy/.  You can also opt-out of Google Analytics here:  https://tools.google.com/dlpage/gaoptout.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights. We do not sell your information to any third parties. 

Please note that we are not responsible for the actions of service providers, third party distributors or platform or service operators (including those on which the PXSH Sites or App is made available) or others. We are not responsible for any additional information you provide to any third parties. Instead, you should review those third parties’ privacy policies and practices to understand your rights.

Your End User Privacy Rights

If you are an EU, you may have certain rights with respect to the personal data you provided to us. To the extent permitted by applicable data protection laws, you may:

Access or modify your personal data;

Object, on grounds relating to your particular situation, at any time to the processing of your personal data if the legal ground we are relying on is our legitimate interest or in the public interest;

 Request that your personal data be erased if it is no longer necessary for the purposes for which it was processed, you have withdrawn consent to, or object to, the processing of such personal data and we meet no other legitimate basis for such processing or it has been unlawfully processed;

Restrict the processing of your personal data if you contest its accuracy or the lawfulness of our processing, we no longer need it but you need it for a legal claim or you have objected to its processing and await verification of our legitimate grounds for processing it;

Under certain circumstances, have your personal data transferred to another company; or

Withdraw any consents that you have previously provided to allow us to process your personal data.

With your consent. If you have allowed us to process your personal data based on consent, you can withdraw your consent to such uses of your personal data that rely on consent as a legal basis to processing at any time by emailing legal@pxsh.com. Please note, such requests will require proper identity verification. 

Behavioral Advertising

Do Not Track

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Minors

The Site is not intended for individuals under the age of 13. Please review the Terms of Use Agreement for further age restriction details. PXSH recognizes the need to adequately protect the privacy of all of its users, especially children. The PXSH App and Sites is not intended for or directed at children under the age of 13. We do not knowingly collect personal data from children under the age of 13. Any content intended for consumers 21+ will always be included in a disclaimer. If we obtain actual knowledge that we have collected personal data from someone under the age of 13, we will promptly delete it, unless we are legally obligated to retain such data. Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

User Responsibility

It is your responsibility to give us current, complete, truthful and accurate information and to keep such information up to date. We cannot and will not be responsible for any problems or liability that may arise if you do not give us accurate, truthful or complete information or you fail to update such information. We will reject and delete any entry that we believe in good faith to be false, fraudulent or inconsistent with this Privacy Policy.
